Tomorrow (Monday, February 21), growers, agriculturists, urban homesteaders and their supporters are asked to blog about urban homesteading, in an effort to let the Dervaes family know that they are NOT such an authority on urban homesteading that they should be able to trademark the idea. If you have the time, please add your blog to the voices raised against this bizarre move on their part.

Certainly we live in interesting times. The rising tide of self-centered, self-serving, selfish "entrepreneurs" who try to carve a chunk out of the commons for their exclusive profit is astounding. May they hear snickering wherever they show their ill-thought-out agenda. Hell, may they be greeted by guffaws so hearty as to induce flatulence.

Uh , maybe they opened the gate for the flock , the father is an ordained Minister , this is from their website:
"Dervaes Institute, established in 2006, is an earth-care ministry and a California\r\nCorporation Sole under California Corporations Code Section 10000-10015\r\nand is tax exempt under IRS Code § 508(c)(1)(A)."
Wouldn't it be nice if all our gardeners were to be tax exempt having earth care ministries ?

Easy enough to get ordained......I did it online in highschool and am on file with the state of Indiana in case a friend needs a favor someday........if I weren't a conscientious man I'd wouldn't be a far leap.

In the context of the words being used together and having a meaning when used together, the USDA has been using them since at least 1940, as referenced from doing a search on the words through the USDA's digital library. HUD has used them since at least the early 1980s when the program I linked above was started. This should NEVER have been approved. The terms were being used together for at least 60 yrs, before Mr. Dervaes started his 'homestead'.
The sad part about this, Dervaes probably filed for the TM status under advice of a lawyer...the type of lawyer who saw $$$ (commonly called patent trolls or IP trolls). In cases like this only the lawyers make money, very often at the expense of those holding the trademark, copyright, patent, etc.

I'm just reading this...someone please tell me this is a joke...These guys always took themselves very seriously, but this beats everything, this can't be serious,no? They always had this 'I am the greatest' attitude, and made a good job out of promoting themselves, while they are only blessed to live in a place with a wonderful climate, and are in fact only re-using knowledge of hundreds of years old (which is perfectly fine to me, but they do make it seem as though they have invented all of this, did they invent the earth as well?) Well, why don't they patent the term 'earth'? Or 'lettuce' or whatever
