Hi,
i need to prove that i can import some seeds of phaseolus (but i'm interested by all kind of seeds) from a genebank to Europe. Can someone point me a good document or resource to figure when i need or not need a phyto certificate ?

The first place I check in with is my local post office. They have a nice big book about what you are allowed to send to where. Presumably they would know about the receiving end of the business as well.

The post office in the US will not help you with importing anything to the states. If you want to import seed, and make sure you get it, a phyto is necessary. I imported seeds from Italy and although I had gone through all the hoops to get my import license, they simply sent the seeds with a phyto and they sailed right through to my door.
Pay the extra for the phyto and you'll always get your seed. If you're importing to Europe, or another country, the US post office will tell you if you can get send them from the US or Canada to wherever.

Thanks for the answers. I doubt that my post office will no anything but i can try. I'm not importing from US or CA. In fact i dont know where the genebank is located

Hi Nicolas,
Every country is different, but France is stricter than most.
I don't know about proving it, but here in NL the ministry of agriculture is usually happy to answer the question over the phone. In the case of NL, almost anything is allowed, and for example I've accepted orders for garlic destined for Germany and corn destined for the Czech republic, where these imports are not allowed, then forwarded the items.
The biggest obstacle for example me sending packages to France, is they almost always open them to look for drugs.
If you're working with genebanks, often a local (French) genebank will help sort out legal issues and phyto certs if they are necessary. If your local genebank doesn't want to help, you might try contacting the genebank in Wageningen, NL, who would probably help sort out these things for you and make sure it arrives with all necessary paperwork.

The document you link to is a directive, meaning it can be interpreted differently in different member states. For example, I have been told explicitly by my department of agriculture that I am allowed to import all citrus (as strange as this seems), as well as prunus scion wood, both things that seem to be forbidden by this directive.
I suggest either calling your department of agriculture or your customs. Both should have a list of botanical names that aren't allowed into the country, and they are usually happy to look things up for you over the phone. Here in the Netherlands, we have one guy in the department of agriculture who is responsible for this list. It took a while to figure out who he is, but now I just call him if I have any questions like this...

Well, the contact point was not the good one, for some reason i dont understand i'd have to contact someone from my own region for the import rules. So phaseolus are in the list of species that need some statements to be imported. the genebank has to issue a document stating that the seeds have been tested for a disease i dont remember the name, or that the seeds are grown in a region where the desease is not present. Hopefully the genebank can do that, and so can send the seeds directly to my home and i have not to pay anything \o/
